HIPAA Compliance Checklist for Mental Health Clinics
HIPAA compliance is not optional for mental health practices. Whether you're a solo therapist or a multi-location counseling center, the Privacy Rule, Security Rule, and Breach Notification Rule apply to how you collect, store, and transmit protected health information (PHI). Here's a practical checklist to assess your compliance posture.
Technical Safeguards
- Access Controls: Implement role-based access with unique user IDs. Every clinician and staff member should have their own credentials — no shared logins.
- Multi-Factor Authentication (MFA): Require MFA on all systems that access PHI, including EHR platforms, email, and cloud storage.
- Encryption: Encrypt data at rest (stored files, databases) and in transit (email, telehealth sessions, file transfers). Use TLS 1.2+ for all connections.
- Endpoint Protection: Deploy endpoint detection and response (EDR) on every device that connects to your network, including personal devices used for telehealth.
- Automated Backups: Schedule encrypted backups daily with offsite storage. Test restoration procedures quarterly to ensure recoverability.
- Audit Logging: Enable access logs on all PHI-containing systems. Logs should capture who accessed what data, when, and from which device.
Administrative Safeguards
- Risk Assessment: Conduct a formal risk assessment annually. Document identified risks, mitigation plans, and remediation timelines.
- Workforce Training: Train all employees on HIPAA policies, phishing awareness, and proper PHI handling during onboarding and annually thereafter.
- Business Associate Agreements: Maintain signed BAAs with every vendor that has access to PHI — your EHR provider, IT company, cloud host, billing service, and telehealth platform.
- Incident Response Plan: Document procedures for identifying, containing, and reporting breaches. Include notification timelines (60 days for affected individuals under the Breach Notification Rule).
- Termination Procedures: Revoke access immediately when employees or contractors leave. Audit accounts quarterly for inactive users.
Physical Safeguards
- Workstation Security: Position screens away from patient view. Use privacy screens on laptops in shared spaces. Lock workstations when unattended.
- Device Management: Maintain an inventory of all devices that access PHI. Enable remote wipe capability on mobile devices.
- Facility Access: Restrict server room and network equipment access to authorized personnel only.
Audit Preparation
Keep these documents current and accessible: your most recent risk assessment, workforce training records, BAA registry, incident response logs, access control policies, and system configuration documentation. When an audit occurs, having organized documentation reduces both stress and the likelihood of findings.
